1. Scope / General matters
www.haar-shop.ch is the online shop of haar-shop.ch AG. The present General Terms and Conditions (hereinafter referred to as GTC) apply to all services provided by www.haar-shop.ch. The offer of www.haar-shop.ch is limited to the geographical area of Switzerland. By placing an order, the customer expressly agrees to these General Terms and Conditions which apply to all services of the online shop (www.haar-shop.ch) of haar-shop.ch AG. haar-shop.ch AG may change the www.haar-shop.ch terms and conditions at any time. Any such amendments shall enter into force immediately upon publication.
2. Products and offers
The entire offer on www.haar-shop.ch is non-binding. haar-shop.ch AG will make every effort to provide correct product descriptions, but these may nevertheless differ from the manufacturer’s description. Haar-shop.ch AG assumes no liability for the accuracy, completeness and topicality of these descriptions. In any case, the customer is requested to take note of the specific product information on the product packaging prior to use. The product images and illustrations on www.haar-shop.ch may differ from the original and the colours shown are non-binding.
The product prices stated on www.haar-shop.ch at the time of the customer's order are binding. Should there be an error in the listed price, haar-shop.ch AG reserves the right to make subsequent price adjustments. If that is the case, the customer will be informed of this circumstance and can withdraw from the purchase within the period set by haar-werk.ch AG. All prices are in Swiss francs including value added tax and excluding shipping costs, unless otherwise stated. The products are usually sent with our shipping partners Swiss Post or Quickpac as Economy (CHF 4.90) or Priority (CHF 7.90; each including VAT). Registration on www.haar-shop.ch is reserved exclusively for persons with full legal capacity. With the order, the customer guarantees that he is at least 18 years old, not under guardianship and capable of judgement. There is no entitlement to admission to the online shop. The customer must provide the required data for registration completely and truthfully. The customer himself is responsible for updating his data.
5. Order / conclusion of contract
The customer's order is only binding once it has been confirmed by haar-shop.ch AG by e-mail. haar-shop.ch AG is free not to confirm an order without providing any reason. With his order, the customer confirms the correctness of all information he provided. Should the customer provide incorrect or incomplete information, haar-shop.ch AG may withdraw from the contract. Haar-shop.ch AG also has the right to withdraw if the products are not available from the manufacturer. In this case, haar-shop.ch AG will endeavour to find an alternative solution after consulting with the customer. If the customer has no need for this, there are no further rights and obligations of the two contracting parties.
haar-shop.ch AG has a large stock of products. Ordered goods that are ordered and confirmed by 6 p.m. by PostPac Priority (A Mail) will be delivered to our customers on the following working day - including Saturdays. Ordered goods that are ordered and confirmed by 6 p.m. by PostPac Economy (B Mail) will be delivered within 2 working days. If individual goods are not in stock, the time of dispatch may be delayed depending on the manufacturer’s delivery times. Delivery periods are always non-binding and delays in delivery shall in no case justify the customer to claim for damages or opt to withdraw from the contract. The customer is obliged to check the delivery immediately upon receipt and to return incorrect or defective deliveries to haar-shop.ch AG within 14 days. All products not returned for these reasons will be invoiced. haar-shop.ch AG exclusively supplies the geographical area of Switzerland and Lichtenstein.
7. Transfer of risk
The risk passes to the customer as soon as the shipment has been handed over to the company carrying out the transport. If the shipment is delayed or becomes impossible through no fault of Haar-shop.ch AG, the risk passes to the customer upon notification of readiness for shipment. A transfer of the transport costs agreed in individual cases by Haar-shop.ch AG has no influence on the transfer of risk.
8. Payment methods
Customers can pay with PayPal, credit card (Master-, Visa- and Diners- Card), Postcard, advance payment, TWINT, or on account. The payment process takes place in any case via a secure SSL encryption technology.
8.1 Purchase on account with instalment option (POWERPAY)
As an external payment service provider, MF Group / POWERPAY offers the payment method ‘purchase on account.’ With the order invoice you can simply pay your online purchase on account. Should you forgo a payment within the specified time frame, you will receive a monthly invoice with an order overview in the following month.
Upon conclusion of the purchase contract, POWERPAY takes over the resulting invoice claim and handles the corresponding payment modalities. When buying on account, you accept the terms and conditions of POWERPAY in addition to our general terms and conditions. (powerpay.ch/en/agb).
8.2 Invoice issuer haar-shop.ch AG
If Haar-shop.ch AG itself acts as the invoice issuer, it is entitled, if the payment deadline stated on the invoice is exceeded, to demand reminder fees of up to CHF 30 per reminder to partially cover the costs incurred. The reminder may be communicated by email, in writing or by telephone. In the event of unsuccessful reminders, haar-shop.ch AG may assign the claim to a third party commissioned with the collection or initiate the process itself. The company entrusted with the collection will claim the outstanding amounts in its own name and for its own account and, like hair-shop.ch AG, may levy additional processing and collection fees.

haar-shop.ch AG reserves the right to limit the quantities delivered for certain products in any case.
11. Right of return / Right of revocation
We guarantee a right to return on products bought from us within 14 days of receipt. The time at which the goods are delivered is decisive for ensuring the deadline.
Returned products and packages are only accepted in good condition, i.e. undamaged, unused, unopened and in the original packaging.
We bear the costs for the return delivery by providing you with a free return delivery slip upon request. You can request the return delivery slip by e-mail (email@example.com), or by telephone under 033 550 30 30.
In any case, the customer is responsible for packing the goods to be returned so that they may be transported. Damage / loss of the goods due to improper packaging will be charged to the customer. If the customer hands over the goods to a transport company, the customer bears the risk for the safe transport of the goods. The transfer of risk to Haar-shop.ch AG only occurs once the goods have arrived at haar-shop.ch AG.
If a gift from a certain purchase value is added to an order (GWP = gift with purchase), restrictions apply when the goods are returned. If the entire order is returned or if the new purchase value falls below the GWP requirement, the gift must also be returned. If the GWP is not returned under these circumstances, the value of the gift will be invoiced.
Intolerances or allergies
haar-shop.ch AG assumes no liability for any allergic reactions or their consequences. If an allergic reaction occurs after using a product, this must be reported by the customer no later than 1 month after the purchase of the product (firstname.lastname@example.org or 033 550 30 30) so that the subsequent steps can be determined. We recommend taking pictures of the allergic reaction and/or having a medical certificate/allergy pass issued.
The warranty conditions of the product suppliers apply. These are included with the products. haar-shop.ch AG provides no further warranty. The customer is required in all cases to contact haar-shop.ch AG to clarify the type of warranty procedure. It is exclusively the right of the supplier to choose which warranties are given in the event of a warranty claim. In the case of appliances, a possible repair is always checked first. The customer alone enjoys any warranty services and cannot transfer these. Damages resulting from improper use, natural wear and tear or other influences that the seller is not responsible for are the responsibility of the customer and do not represent a warranty case.
13. Complaint deadline
Defects must be reported in writing within 14 days of receiving the goods. Otherwise the goods shall be deemed to be in perfect condition and accepted by the customer.
14. Transport damages
Transport damage must be reported in writing within 5 days both to Swiss Post/Quickpac and to haar-shop.ch AG. The customer bears the risk of transport damages, as far as he cannot transfer these to the forwarder.
15. Data protection
haar-shop.ch AG excludes, to the extent permitted by law, any liability vis-a-vis the customer for damages and consequential damages (e.g. as a result of accidents and/or injuries suffered regarding the products sold by haar-shop.ch AG). Under no circumstances shall breach of contract, impossibility of performance, fault at the time of conclusion of the contract or in tort justify claims for damages or a right to withdraw from the contract.
17. Applicable law / court of jurisdiction
The contract is subject exclusively to the Swiss Code of Obligations and other standards issued by Swiss legislation.
The place of jurisdiction for all disputes with haar-shop.ch AG is Uetendorf, Switzerland - subject to deviating mandatory jurisdiction under federal law.
